ORDER OF DISMISSAL

This matter is currently pending before the South Carolina Administrative Law Judge Division pursuant to the Appellant’s Notice of Appeal filed on March 28, 2003. On April 2, 2003, an Order Governing Procedure was issued by the undersigned judge requiring the Appellant to file his brief within fifteen (15) days following the receipt of the Record on Appeal. The Record On Appeal was submitted from the Department on April 25, 2003. The Appellant has not filed a Brief.

On July 1, 2003, a letter was sent to the Appellant with a copy to the Respondent stating that the Brief of Appellant should be filed within ten days of the date of the letter. No Appellant Brief has been received.

Therefore, pursuant to ALJD Rule 38 this matter must be dismissed. ALJD Rule 38

provides, “...[a]n administrative law judge may dismiss an appeal for failure to comply with any of the rules of procedure for appeals, including the failure to comply with any time limits provided by this section.”

It is hereby ORDERED that this appeal is DISMISSED.

AND IT IS SO ORDERED.
