ORDERS:
ORDER OF DISMISSAL
The above-captioned matter was filed with the Administrative Law Judge Division
(Division) on July 9, 2003. The Department of Revenue (Department) was excused from
appearing in this matter because but for the protest it received from the Protestant it would have
issued the permit in question. On July 29, 2003, this office received a letter from Lee Hewitt, the
Protestant in this matter, which set forth that he and the Petitioner have agreed to the following
conditions being placed on the Petitioner’s permit:
1.The hours of operation will be from 11:00 a.m. until 10:00 p.m.;
2.This permit is for beer and wine service at tables only with meals; and
3.No outside music or trash will be allowed.
Based on these terms in which the Petitioner and the Protestant entered into a signed
written agreement attached hereto, the Protestant set forth that he was withdrawing his protest in
this case. Therefore,
IT IS HEREBY ORDERED that this matter is dismissed.
AND IT IS SO ORDERED.
