ORDERS:
ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division ("Division") for a
contested case hearing upon the request of Ruby Payne, d/b/a Magnum's ("Petitioner").
Petitioner filed an application with the South Carolina Department of Revenue ("Respondent")
for an on-premise beer and wine permit. The application was forwarded to the Division for a
contested case hearing, citing Respondent's challenge of Petitioner's South Carolina residency
status, and further failure by Petitioner to truthfully answer all questions on the application for a
beer and wine permit. The merits hearing was scheduled for July 30, at 10:00 a.m. at the
Division. In a letter dated July 5, 2001, counsel for Petitioner notified the Division of
Petitioner's desire to withdraw the application. By virtue of Petitioner's request for withdrawal
of said application, there appears to be no further controversy for consideration.
IT IS THEREFORE ORDERED that the hearing previously scheduled as outlined above, is
hereby CANCELED.
IT IS FURTHER ORDERED that the above-captioned case matter is hereby DISMISSED.
AND IT IS SO ORDERED.
