ORDER OF DISMISSAL

This matter is pending before the Administrative Law Judge Division. The Department of Revenue (DOR), excused by an order dated May 25, 2001, stated in its Transmittal Form dated May 8, 2001, that DOR would have issued the license except for the license having been protested. On May 14, 2001, in a letter from W. Kurt Taylor, Attorney for Charleston County, as Intervenor, stated they are withdrawing their protest in this matter. After diligent efforts were made by the Court to contact Mr. Lenny Dew, named as a Protestant in this matter, the Court was unable to reach Mr. Dew, however, the Court was informed by the Intervenor, that it was their understanding that Mr. Dew also joined in the withdrawal of his protest. The City of North Charleston had previously withdrawn its protest on May 14, 2001. There being no further opposition,



IT IS HEREBY ORDERED that the above-captioned case be and hereby is dismissed due to this license not being protested. Further, DOR is directed to proceed to issue the requested license.



AND IT IS SO ORDERED.
