ORDERS:
ORDER
This matter is before me pursuant to the request for a contested case hearing filed with the
Administrative Law Judge Division (ALJD) on April 25, 2001. Petitioner applied for a retail liquor
license with Respondent South Carolina Department of Revenue (Department). According to the
Department's Agency transmittal filed with the ALJD, the Department found that based on the
information submitted in the Petitioner's application and the investigation of the South Carolina State
Law Enforcement Division the Petitioner appeared to meet all statutory requirements for a retail liquor
license. The Department would have issued the license but for the protest filed by Mr. John Morrell,
d/b/a Morrell Liquors, Inc. (Morrell Liquors). However, Counsel for Morrell Liquors has informed this
tribunal of its withdrawal of the protest.
The Department would have continued processing Petitioner's application but for the protest of Morrell
Liquors. The protest has been withdrawn, therefore, the Department should resume the application
process for the Petitioner. Any license issued pursuant to the instant application shall
contain the following stipulation:
The Applicant agrees not to use the word "wholesale" inside the store on any advertising or other
promotional matter, including employee uniforms.
IT IS HEREBY ORDERED that the Department shall continue to process Petitioner's application for
a retail liquor license.
