DOCKET NUMBER:

APPEARANCES:
Eddye L. Lane, Esquire, for the Petitioner

Nicholas P. Sipe, Esquire, for the Department of Revenue

ORDERS:

ORDER OF REMAND

This matter is before me pursuant to the Department of Revenue's denial of the Petitioner's application for an on-premise beer and wine permit and sale and consumption license for K.J.'s, located at 432 Broad Street, Sumter, South Carolina.

After the commencement of the hearing into this matter, the parties reached an agreement whereby the Petitioner agreed to withdraw his application for a sale and consumption license and the Department agreed to process and grant the Petitioner's application for an on-premise beer and wine permit for K.J.'s.

Therefore, finding good cause,

IT IS HEREBY ORDERED that this matter is REMANDED to the Department of Revenue so that the Department can continue to process and issue the Petitioner his on-premise beer and wine permit, for K.J.'s, 432 Broad Street, Sumter, S.C., upon the Petitioner's payment of the required fees and costs.

AND IT IS SO ORDERED.
