The above-captioned matter was scheduled to be heard on Thursday, March 15, 2001, at the offices of the Administrative Law Judge Division (Division). On February 15, 2001, the Department of Revenue forwarded a letter to the Division from Pastor Rodney Schultz, the sole Protestant in this matter, setting forth that he was withdrawing his protest. The Department of Revenue (Department) was excused from appearing in this matter by my Order dated January 24, 2001, because the Department would have issued this permit but for the protests of the Protestant(s). Therefore, finding good cause,

IT IS HEREBY ORDERED that this matter is dismissed and that the Department resume processing the Petitioner's application.

AND IT IS SO ORDERED.
