ORDERS:
FINAL ORDER
Respondent Department of Revenue (Department) filed the Agency Transmittal for the above referenced matter with the
Administrative Law Judge Division (Division) on October 12, 2000. Petitioner requested a hearing with the Division pursuant to the
Department's denial of an application for an Off-Premises Beer and Wine permit for the Petitioner's business located in Georgetown,
South Carolina. According to the Agency Transmittal, the Petitioner did meet all statutory requirements for an Off-Premises Beer
and Wine permit. However, the Department denied the permit because concerned citizens questioned the suitability of the location of
the business. The only opposing party named in the Agency Transmittal as a protestant was H. Randall Dozier. The Department
stated that but for the question of suitability of the location being raised by the protestant, the Department would have issued the
permit.
By letter dated November 27, 2000, Mr. H. Randall Dozier informed the Division that he no longer wants to contest the Petitioner's
application for the permit and does not intend to pursue this matter. It follows, that since Mr. Dozier was the only protestant in this
matter and has now withdrawn, the Department may now issue the Off-Premises Beer and Wine permit to the Petitioner Julia Dozier,
d/b/a Dozier's Grocery.
IT IS THEREFORE ORDERED that the Department shall issue the Off-Premises Beer and Wine permit to the Petitioner for the
referenced business location.
IT IS FURTHER ORDERED that the hearing scheduled for November 29, 2000 at 10:00 a.m. is canceled.
AND IT IS SO ORDERED.
