ORDERS:
FINAL ORDER AND DECISION
This matter comes before me pursuant to S.C. Code Ann. Sections 61-2-260, 61-4-520, and 61-4-525 (Supp. 1999) upon
the Petitioner's request for a contested case hearing. The Petitioner, Teresa Rayfield, d/b/a Fifth Avenue Bar & Grill, seeks
an on-premises beer and wine permit. After the Protestant filed a written protest with the South Carolina Department of
Revenue ("DOR"), and upon the Petitioner's request, this matter was transmitted by DOR to the Administrative Law Judge
Division ("ALJD").
DOR stated in the Agency Transmittal that but for the questions being raised about the suitability of the location by
the Protestant, DOR would have issued the permit.
By letter dated October 16, 2000, the Protestant informed the ALJD that she no longer wished to protest the
Petitioner's application for a license.
Based on the matters contained in the Agency Transmittal and the letter of the Protestant, IT IS THEREFORE
ORDERED, that DOR shall continue processing the Petitioner's application for an on-premises beer and wine permit.
AND IT IS SO ORDERED.
