ORDER OF DISMISSAL

This matter is currently pending before the South Carolina Administrative Law Judge Division and was scheduled for a hearing on the merits for 10:00 a.m., February 26, 2001. The Petitioner appeals the Respondent's failure to grant his request for an on-premises beer and wine permit. The Respondent would have granted the application but for the protest by the Chesterfield County Sheriff's Department concerning the suitability of the location.

At the hearing, no one from the Chesterfield County Sheriff's Department was present. After waiting twenty minutes, the hearing was reconvened, and no one from the Sheriff's Department was present. No one from the Sheriff's Department contacted the Court requesting a continuance. Therefore, the Sheriff's Department's protest is deemed abandoned. Because the Respondent would have granted the permit but for the protest, the permit must be granted. It is

ORDERED that the South Carolina Department of Revenue grant the Petitioner the requested on-premises beer and wine permit.

IT IS FURTHER ORDERED that this contested case is DISMISSED WITH PREJUDICE.

AND IT IS SO ORDERED.
