ORDERS:
ORDER OF DISMISSAL
The above referenced case is pending before the Administrative Law Judge Division. On January 20, 2003, a
letter was written by Michael D. Owens, Attorney for Petitioner with the information that a settlement
had been reached between Riverview Tavern, Inc., Petitioner and the Pickens County Sheriff's Office,
Protestant.
The Pickens County Sheriff's Office consents to withdraw its protest and in return, Riverview Tavern, Inc.
agrees to operate under certain restrictions incorporated into its license. The restrictions are as follows:
1. On all nights of operation other than Friday, Petitioner shall cease serving or dispensing liquor at
midnight, but may stay open until 2:00 a.m. and serve other beverages (such as beer and wine) until closing
time
- On Friday night operations, Petitioner shall cease serving or dispensing liquor at 1:00 a.m. Saturday
morning, but remain open until 2:00 a.m. and serve other beverages (such as beer if wine) until closing
time.
Except for the protest filed in this matter by the Pickens County Sheriff's Office, The South Carolina
Department of Revenue would have issued the permit to Riverview Tavern, Inc.
Accordingly, with no protest existing, the Department of Revenue shall continue to process the
application for a liquor license with the above mentioned restrictions.
AND IT IS SO ORDERED.
