The above-entitled case is pending on appeal in this Division. Prior to the hearing, the Court was advised by Daniel C.
Patterson, attorney for Petitioner, that Petitioner wishes to withdraw its appeal. A copy of letter dated November 11, 2002
confirming Petitioner's position is attached hereto and made a part of this Order.
