ORDER

This matter comes before this tribunal pursuant to S.C. Code Ann. § 61-2-260 (Supp. 2002) and S.C. Code Ann. §§ 1-23-310 et seq. (1986 & Supp. 2002) for a contested case hearing. Petitioner Katy’s Inc., d/b/a Katy’s Bar and Grill, seeks a renewal of its on-premises beer and wine permit and sale and consumption (“minibottle”) license for its location at 1125 N. Main Street, Darlington, South Carolina. The South Carolina Department of Revenue (“Department”) would have issued the renewal permit and license but for the question raised by the Protestants, Margaret C. Hopkins, Angela Gainey, and Tommy Edwards (collectively “Protestants”), regarding the suitability of the location in light of its proximity to their residential neighborhood and past problems with disturbances and loud music. Accordingly, the Department was excused from the hearing of this matter. Notice was sent to the parties and the Protestants scheduling a hearing of this matter for July 30, 2003, at the Administrative Law Judge Division (“ALJD”) in Columbia, South Carolina. On July 21, 2003, the Protestants notified this tribunal in writing that they are withdrawing their protest. Therefore,

IT IS HEREBY ORDERED that the hearing scheduled for July 30, 2003 is canceled;

IT IS FURTHER ORDERED that the Petitioner’s renewal application for its on-premises beer and wine permit and sale and consumption (“minibottle”) license for its location at 1125 N. Main Street, Darlington, South Carolina, is granted;

AND IT IS SO ORDERED.
