CONSENT ORDER

The South Carolina Department of Revenue (Department) initiated this matter by issuing a finding that Fred H. Wood Oil Company, Inc., located at 8314 Hwy 14, Gray Court, South Carolina, had violated 23 S.C. Code Ann. Regulation 7-9(B)(Supp. 2002), by “permitting the purchase of beer by a person under the age of twenty-one.” Prior to a hearing on this matter, Respondent conceded the violation and paid the fine of $400.00. Because there remains no matter at issue, Respondent and the Department withdraw the request for a contested case hearing and request that the matter be dismissed with prejudice.

Based on the foregoing, because the parties no longer request a contested case hearing on this matter, it is DISMISSED WITH PREJUDICE. The court finds the agreement fair and reasonable.
