I. Introduction
The South Carolina Department of Corrections (DOC) asserts that the instant matter is a duplicate filing of
another case pending by Mark Simril (Simril) identified as Docket No. 00-ALJ-04-00923. Accordingly,
DOC seeks a dismissal. After reviewing the arguments, the instant case is dismissed.
II. Analysis
The documents which relate to the error complained of by Simril in this appeal are virtually identical to those
filed in Docket No. 00-ALJ-04-00923. Accordingly, the instant case is a duplicate of an existing case and
must be dismissed.
III. Order
This matter is dismissed as a duplicate of the case identified as Docket No. 00-ALJ-04-00923.
