ORDERS:
ORDER OF DISMISSAL
This matter comes before the Administrative Law Judge Division ("Division") pursuant to the appeal of Ronald Elleby, an inmate
incarcerated with the Department of Corrections ("Department") since March 16, 1998. On March 29, 2000, Appellant was
convicted of sexual misconduct under SCDC Disciplinary Code 2.9. Appellant lost telephone and canteen privileges as a result of
the conviction. Inmate Elleby filed this appeal with the Division on August 17, 2000, pursuant to the jurisdiction conferred by the
South Carolina Supreme Court in Al-Shabazz v. State, 338 S.C. 354, 527 S.E.2d 742 (2000). On December 19, 2000, the
Department filed its response brief. The Department has reconsidered its decision and agrees to reverse the conviction and grant
Appellant the relief requested by reinstating privileges lost as a result of this conviction, thereby rendering this appeal moot.

Because there are no further justiciable issues for appeal, IT IS HEREBY ORDERED that Inmate Elleby's appeal is hereby
DISMISSED with prejudice.
AND IT IS SO ORDERED.
