ORDERS:

CONSENT ORDER

The South Carolina Department of Revenue (Department) initiated this matter by issuing a finding that Spotlight Social Club, Inc.., located at 6013 Augusta Road, Greenville, South Carolina, had violated 23 S.C.Code Ann. Regulation 7-17J and S.C. Code Ann. Section 61-6-2600, “refilling minibottles” (Supp. 2002). Prior to a hearing on this matter, the Spotlight and the Department resolved the matter as set forth below:

1.Spotlight Social Club Inc. admits that it violated the above provisions on October 6, 2002. For these violations it has surrendered its sales and consumption license and beer and wine permit on this day, Thursday, June 12, 2003. Further, Spotlight agrees to remit the fine set forth in the Final Department determination of $1,500.00, to the Department, no later than July 15, 2003.

2. In consideration of the above, the Department accepts the revocation and fine in satisfaction of the violations in this matter.

The parties freely and voluntarily entered into this agreement. Further, the parties agree that this constitutes the full and final resolution of this violation and such is resolved with prejudice

I find this agreement to be fair and equitable, approve such agreement, and hereby Order its adoption. This court retains continuing jurisdiction to enforce this Order. As Respondent no longer requires a hearing on this matter, I also Order this matter Resolved With Prejudice.

AND IT IS SO ORDERED.
