This matter is currently pending before the South Carolina Administrative Law Judge Division pursuant to the Appellant's Notice of Appeal filed on August 2, 2000. The Respondent filed a Motion to Dismiss on September 11, 2000 asserting that the Appellant has failed to exhaust his administrative remedies prior to filing this appeal.

An appellant is required to exhaust his administrative remedies prior to filing an appeal. Matter of Chrisanthis, 315 S.C. 382, 434 S.E.2d 254 (S.C. 1990). Appellant filed his Step 1 Grievance Form on July 21, 2000, and it was returned unprocessed. There is no evidence that the Appellant filed a Step 2 Grievance Form with the Respondent. The Appellant, therefore, has not exhausted his administrative remedies prior to filing this appeal, and this matter must be dismissed.

IT IS THEREFORE ORDERED that this matter is DISMISSED WITH PREJUDICE.

AND IT IS SO ORDERED.
