ORDER OF DISMISSAL

A hearing on the above proposed regulation was set for Wednesday, June 11, 2003, at 9:00 p.m. ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp.2002) on the basis that a request for a hearing was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. The Court was advised by letter dated May 28, 2003, from Susan Duncan, Assistant Legislative Liaison for the South Carolina Department of Labor Licensing and Regulation, that the Division of Labor did not receive any requests for a hearing on the proposed regulation in the above matter, and that the hearing will not be necessary.


IT IS THEREFORE ORDERED that the above-captioned case bearing Docket Number 03-ALJ-11-0151-RH is hereby dismissed.


AND IT IS SO ORDERED.
