ORDERS:
ORDER OF STIPULATION OF DISMISSAL WITH PREJUDICE
This
matter was initiated by Murphy’s G.C., Inc., d/b/a Murphy’s Law South (the
Company) filing of a Motion to Remove Assessment and Remand (Motion) to the
South Carolina Department of Revenue (Department) filed May 1, 2006.
Prior
to the hearing scheduled on this matter for Thursday, August 24, 2006 at 10:00
a.m., the Company has agreed this day, August 22, 2006, to withdraw its
Motion. The Company further agrees to pay the valid assessment of $500.00
within ten days of the filing of this Order. The Department consents.
The
parties further agree that they freely and voluntarily entered into this
Stipulation and such constitutes the full and final resolution of this Motion
and the Company’s Motion shall be dismissed with prejudice.
Based
on the foregoing, the Company shall pay the $500.00 valid assessment to the
Department within ten days of the filing of this Order. Further, there being
not remaining issues before this Court, the Company’s Motion is DISMISSED
WITH PREJUDICE.
