By letter filed with the Administrative Law Court on August 15, 2006, Petitioner indicates that the Respondents in the above referenced enforcement case have provisionally settled the matter brought by the South Carolina Department of Consumer Affairs. The Respondents have submitted all filing materials, including proof of a current bond, a $300 administrative fine, and an amended contract that complies with the Physical Fitness Act. The Department requests that this action be dismissed without prejudice, allowing the Department to reopen the case if necessary.

IT IS THEREFORE ORDERED that the above referenced case is HEREBY DISMISSED WITHOUT PREJUDICE.

AND IT IS SO ORDERED.
