ORDERS:
ORDER OF DISMISSAL
The above-entitled case is pending before the Administrative Law Judge Division. On April
14, 1998, a letter was received from Arlene D. Hand, Attorney for Petitioner, stating, "The above-referenced matter is scheduled for hearing at 9:30 a.m. on April 16, 1998. The permittee was
charged with permitting a criminal act: possession of gambling devices. We have been advised that
the clerk, Eric Zacour, has been found not guilty of the gambling charge. Consequently, the violation
before the court must be dismissed by the Department. Based on the foregoing, we respectfully
request that the matter before the court be dismissed with prejudice and the hearing canceled".
Therefore, IT IS ORDERED that the above-captioned case be and hereby is dismissed and
the hearing which was scheduled for Thursday, April 16, 1998, at 9:30 a.m. has been canceled.
AND IT IS SO ORDERED.
