ORDERS:

CONSENT ORDER

1. On July 6, 1998, Phillip S. Porter, Consumer Advocate for the State of South Carolina (the Consumer Advocate), requested the South Carolina Department of Insurance (the Department) to initiate a public hearing on the filing of American Bankers Insurance Company (the Company) requesting an approval of an increase of its mobile home owners property and casualty insurance premium rates.

2. On July 10, 1998, the Department filed with the Administrative Law Judge Division (ALJD) an Agency Transmittal Form requesting a public hearing in accordance with the rules of this Division.

3. The ALJD assigned this matter to the Honorable Ralph K. Anderson under the Docket No. 98-ALJ-09-0420-CC. The public hearing on this proposed rate increase has been scheduled for October 14, 1998, at 2:00 p.m.

4. Meanwhile, the Department and the Consumer Advocate requested additional information from the Company. Subsequent discussions between the Company and the Department allayed the Department's original concerns about the excessiveness of the rate increases by this company. The Company agreed to modify its rate increase request and cap them. The modified rate increase requests do not exceed twenty percent.

5. Because of the additional information and clarifications provided by the Company, and the modifications made to the filing by the Company, the Department no longer believes that the filing will result in rates that are excessive, inadequate or unfairly discriminatory. The original request for a hearing in this matter is now withdrawn via consent of all the parties.

6. There are no unresolved issues remaining; therefore, all parties agree to the dismissal of this matter.

NOW, THEREFORE, the above referenced matter is dismissed.

IT IS SO ORDERED.
