ORDERS:

CONSENT ORDER

1. On April 17, 1998, Philip S. Porter, Consumer Advocate for the State of South Carolina (the Consumer Advocate) requested the South Carolina Department of Insurance (the Department) to initiate a public hearing on the filing of American Family Home Insurance Company (the Company) requesting an approval of an increase of +10.7% in its mobile home insurance rates.

2. On April 29, 1998, the Department filed with the Administrative Law Judge Division an Agency Transmittal Form requesting a public hearing.

3. The Administrative Law Judge Division assigned this matter to Honorable Stephen P. Bates under the Docket No. 98-ALJ-09-0256-CC. The hearing on the matter has not yet been scheduled.

4. Meanwhile, the Consumer Advocate requested additional information from the Company. Subsequent discussions between the Company and the Consumer Advocate allayed the consumer Advocate's original concerns about this filing, in particular with respect to loss cost projection factors and the modifications in the hurricane model. The Consumer Advocate also recognizes that the Company through this program insures the hard to serve market.

5. Because of the additional information and clarifications provided by the Company, the Consumer Advocate no longer believes that the filing will result in rates that are excessive, inadequate or unfairly discriminatory, and now withdraws his original request for a hearing in this matter.

6. There are no unresolved issues remaining; therefore, all parties agree to the dismissal of this matter.

NOW, THEREFORE, the above referenced matter is dismissed.

IT IS SO ORDERED.
