ORDERS:
CONSENT ORDER OF DISMISSAL
This
matter is before the Court pursuant to the Petitioner's Request for a Contested
Case Hearing. The Petitioner is appealing the Final Determination by the Respondent,
the South Carolina Department of Revenue, wherein the Department denied the
issuance of an On-premise Beer and Wine Permit to Petitioner. The Department
based its denial on the receipt of a Protest from the City of Charleston Police
Department - filed in opposition to the issuance of the permit. The
Department also denied the issuance of the permit to the Petitioner as a result
of its concerns over the true ownership of the proposed location.
Prior
to the call of the case before this Court, the parties, as attested to by the
parties’ undersigned signatures, by and through their respective attorneys, have
indicated that the matter has been resolved as between them and that the
Protest has been withdrawn. The parties therefore seek the dismissal of this
matter now pending before the Court.
WHEREFORE, based
upon the foregoing, this matter is hereby dismissed with prejudice.
