ORDER OF DISMISSAL

a letter dated August 2, 2006, Petitioner Tantus Tobacco, LLC, informed this
Court that the issues raised in the above-captioned matter have been resolved,
thus rendering this case moot. Accordingly, Petitioner seeks to withdraw its
request for a contested case hearing in this matter.
IT
IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED with prejudice.
