ORDERS:
ORDER OF STAY
A
conference call was held on May 30, 2006 among the parties and Judge Carolyn C.
Matthews to discuss the status of this matter. The parties have stipulated that
the sole issue in this contested case hearing is the ownership of the marsh across
which the Respondent Burgess has applied to build a dock. Based on this
stipulation, and since the issue of ownership is currently on appeal to the
South Carolina Court of Appeals, this matter shall be stayed pending a decision
by the Court of Appeals. All parties shall have all rights of appeal from the
decision of the Court of Appeals, regardless of this stay.
In addition, the hearing set for June 15, 2006 at the South Carolina Administrative
Law Court is cancelled. The parties shall notify this court of the status of
the appellate case on or before October 2, 2006.
AND IT IS SO
