ORDERS:
ORDER OF DISMISSAL
This
matter is currently pending before the South Carolina Administrative Law
Court. This matter involves the denial of the Petitioner’s request for an
off-premises beer and wine permit by the Department of Revenue based on a
public protest as to suitability of the location by R.H. Patterson. Based on
the Agency Information Sheet sent by the Department, but for this protest, the
permit would have been granted. By letter faxed on April 14, 2006, the
Protestant withdrew his protest due to his inability to attend the hearing.
Because the Department would have granted the permit but for the protest, and
the protest has been withdrawn, it is hereby:
ORDERED that this matter is dismissed with prejudice and the hearing set for April 18,
2006 is hereby cancelled.
IT
IS FURTHER ORDERED that the Department of Revenue issue an off-premises
beer and wine permit to the Petitioner for the location at 202 Piedmont Highway
20, Piedmont, SC.
AND
IT IS SO ORDERED.
