ORDERS:
ORDER OF DISMISSAL
On
August 26, 2005, SouthCross Surgery Center, LLC, filed a Motion to Dismiss this
matter, asserting that it no longer seeks any relief from this Court as it has
resolved the controversy. The South Carolina Department of Health and
Environmental Control (DHEC), Piedmont Healthcare System, Inc., and Carolina
Surgery Center, LLC, each joined in this motion.
By
Order dated October 17, 2005, in the interest of judicial economy, I held this
matter in abeyance pending the outcome of Carolinas Healthcare System’s (CHS) appeal
to the DHEC Board of my April 20, 2005 Order which dismissed them as an
Intervenor/Respondent from this case. On March 20, 2006, the DHEC Board issued
an Order on the appeal, affirming my decision, of which the parties notified
the Court. Accordingly,
IT
IS HEREBY ORDERED that the Motion to Dismiss this matter is GRANTED and this matter is DISMISSED with prejudice.
AND
IT IS SO ORDERED.
