ORDERS:
ORDER OF DISMISSAL
This
matter is currently pending before the South Carolina Administrative Law Court
(ALC or Court) pursuant to a request for a contested case hearing regarding the
administrative denial of Petitioner’s application for on off-premises beer and
wine permit. The Department denied Petitioner’s application for the permit
because the prior license holder had not surrendered the license for the
location.
By
letter dated April 7, 2006, Respondent informed the Court that it had received
the original beer and wine permit from the prior license holder and therefore
requested that the matter be dismissed. Accordingly,
IT
IS HEREBY ORDERED that the hearing scheduled for 3:00 p.m. on Thursday,
April 13, 2006, is cancelled and that this matter is dismissed with prejudice.
AND
IT IS SO ORDERED.
