ORDERS:
ORDER OF DISMISSAL
This
matter is currently pending before the South Carolina Administrative Law
Court. This matter involves the denial of the Petitioner’s request for an
on-premises beer and wine permit and restaurant minibottle license by the
Department of Revenue based on a public protest as to suitability of the
location by James F. Julian. Based on the Agency Information Sheet sent by the
Department, but for this protest, the permit would have been granted. By
letter received on April 1, 2006, the Protestant withdrew his protest due to
his inability to attend the hearing. Because the Department would have granted
the permit but for the protest, and the protest has been withdrawn,
IT
IS HEREBY ORDERED that the hearing scheduled for 10:00 a.m. on Tuesday,
April 11, 2006, is cancelled and that this matter is dismissed with prejudice.
IT
IS FURTHER ORDERED that the Department of Revenue issue an on-premises beer
and wine permit and restaurant minibottle license to the Petitioner for the
location at 107 East Butler Avenue, Mauldin, South Carolina.
AND
IT IS SO ORDERED.
