ORDERS:
ORDER OF DISMISSAL
This matter is
currently pending before the South Carolina Administrative Law Court. This
matter involves a request for a contested case hearing by the Respondent after
a denial of the renewal of an on-premises beer and wine permit and private club
minibottle license by the Department of Revenue. The denial was issued as a
result of protests challenging the suitability of the location. A Motion to
Dismiss dated March 10, 2006 from counsel for the Petitioner was received by
the Court on March14, 2006. Mr. Whiten indicated that the Petitioner had been
released from the lease of the proposed location at 3501 South Murray Avenue,
Anderson, SC and moved for a dismissal of this action. Therefore, having no
request for a hearing, it is hereby
ORDERED that this matter is dismissed with prejudice. The hearing set for March 22,
2006 is hereby CANCELLED.
AND IT IS SO
ORDERED.
