ORDERS:
ORDER OF DISMISSAL
This
matter is currently pending before the South Carolina Administrative Law
Court. This matter involves the denial of the Petitioner’s request for an
on-premises beer and wine permit by the Department of Revenue based on a public
protest as to suitability of the location by James F. Julian. Based on the
Agency Information Sheet sent by the Department, but for the public protests,
the permit would have been granted. By letter received on March 20, 2006, the
aforementioned Protestant withdrew his protest. Because the Department would
have granted the permit but for the protest, and the protest has been
withdrawn, it is hereby:
ORDERED that this matter is dismissed with prejudice, and the hearing set for Tuesday,
March 21, 2006 is cancelled;
IT
IS FURTHER ORDERED that the Department of Revenue issue an on-premises beer
and wine permit to the Petitioner for the location at 785 D East Butler Road,
Bld. B, Mauldin, SC.
AND
IT IS SO ORDERED.
