ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division
pursuant to Midlands Utility, Inc.’s request for a contested case hearing to challenge
Administrative Order 02-266-W, issued by the South Carolina Department of Health and
Environmental Control on December 20, 2002. Prior to a hearing being held in the ALJ
Division, the parties executed Consent Order 03-043-W, which resolved all outstanding
issues related to this matter and brings litigation of this case to a close. Consent Order 03-043-W is attached and incorporated into this Consent Order of Dismissal by reference. Accordingly, by and with the consent of the parties, it is ordered and agreed that
this contested case be dismissed.
AND IT IS SO ORDERED.
