ORDER OF DISMISSAL

This matter comes before this tribunal pursuant to S.C. Code Ann. § 61-2-260 (Supp. 2002) and S.C. Code Ann. §§ 1-23-310 et seq. (1986 & Supp. 2002) for a contested case hearing on Petitioner’s application for an on-premises beer and wine permit and a restaurant minibottle license for the premises located at 3636 Highway 90 in Longs, South Carolina. Respondent South Carolina Department of Revenue denied Petitioner’s application because of a protest filed against the application by Tommy Johnson and because Petitioner did not yet have proper licensure to serve food on the premises. However, by letter dated February 6, 2003, Mr. Johnson withdrew his protest of Petitioner’s application. Accordingly, on April 3, 2003, Petitioner moved to dismiss this contested case and return this matter to the Department for further processing, including a final inspection of the location to determine whether she has proper licensure to prepare and serve meals on the premises.

IT IS THEREFORE ORDERED that the Department of Revenue shall continue to process Petitioner's application for an on-premises beer and wine permit and restaurant minibottle license for the premises located at 3636 Highway 90, Longs, South Carolina.

AND IT IS SO ORDERED.
