ORDERS:
CONSENT ORDER OF DISMISSAL
This
matter came before the South Carolina Administrative Law Court as a request for
a contested care hearing by the Petitioner, to contest a Final Agency
Determination issued by the Respondent, South Carolina Department of Revenue (Department),
assessing sales taxes, penalties, and interested against the Petitioner. The
parties have now reached an agreement resolving this matter as follows:
1. The
taxpayer agrees to pay tax and interest to the Department in the total amount
of $10,402.88 on or before May 8, 2006
2. The
Department agrees to accept this amount in completed resolution of its November
17, 2005 Final Agency Determination covering the audit period of September 1,
2002 through October 31, 2003.
Having
reviewed this agreement in settlement and compromise as set forth, I hereby
order its adoption and dismiss the Petition in this matter with prejudice.
IT IS SO ORDERED.
