ORDERS:
ORDER OF DISMISSAL
In
the above-captioned cases, Petitioner J. Rutledge Young, Jr., challenges the
decision of Respondent South Carolina Department of Health and Environmental
Control, Office of Ocean and Coastal Resource Management (Department), to issue
permits to two adjacent property owners, Respondents Tanzy Moore and Christine
Duc, for the construction of docks with boatlifts in Church Creek on Wadmalaw
Island in Charleston County. By an Order dated August 5, 2005, these cases
were stricken from the active docket of this Court while the parties pursued
the settlement of these matters. Subsequently, on January 31, 2006, the
parties filed Consent Orders of Dismissal in these cases. In each case, the
parties resolved their dispute by replacing the proposed 15’ x 15’ four-pile
boatlift on the dock with a single 8’ x 22’ jet dock. These Consent Orders are
approved and their terms are hereby incorporated by reference into this Order
of Dismissal. Therefore, as there are no justiciable issues remaining in
controversy in these matters,
IT
IS HEREBY ORDERED that the above-captioned cases are DISMISSED with
prejudice pursuant to the Consent Orders of Dismissal filed by the parties.
AND
IT IS SO ORDERED.
