ORDER OF DISMISSAL

A hearing on the above proposed regulation was set for Tuesday, January 24, 2006, at 1:00 PM. ALC Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp.2004) on the basis that a request for a hearing was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. The Court was advised by letter dated January, 10, 2006, from Susan Duncan, Legislative Coordinator, that the Department did not receive any requests for a hearing on the proposed regulation in the above matter, and that the hearing will not be necessary.

IT IS THEREFORE ORDERED that the above-captioned case bearing Docket Number 05-ALJ-11-0421-RH is hereby dismissed.

AND IT IS SO ORDERED.
