ORDERS:
ORDER OF DISMISSAL
By a
letter filed on January 4, 2006, Claude Auerbach and Elizabeth Auerbach, the
sole protestants of record in the above-captioned cases, notified the Court
that they wished to withdraw their protest of Petitioner’s applications for an
off-premises beer and wine permit and a retail liquor store license.
Therefore, as the only protestants of record in these cases have withdrawn
their protest of Petitioner’s permit and license applications, see S.C.
Code Ann. §§ 61-4-525 (Supp. 2004), 61-6-185 (Supp. 2004); 23 S.C. Code Ann.
Regs. 7-201(6) (Supp. 2004),
IT
IS HEREBY ORDERED that the hearing of the above-captioned matter scheduled
for Thursday, January 19, 2006, is CANCELED and these cases are DISMISSED.
IT
IS FURTHER ORDERED that, pursuant to this dismissal, the South Carolina
Department of Revenue shall CONTINUE TO PROCESS Petitioner’s
applications for an off-premises beer and wine permit and a retail liquor
license for the premises located at 108 Buckwalter Parkway 2-F and 2-G,
respectively, in Bluffton, South Carolina.
AND
IT IS SO ORDERED.
