ORDERS:
ORDER OF DISMISSAL
A hearing on the above proposed
regulation was set for Thursday, December 15, 2005, at 10:00 a.m., pursuant to
a Notice of Hearing dated October 18, 2005. ALJD Rule 45 requires the agency
to provide a statement, at least ten (10) days before the scheduled hearing
date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110
(Supp.2004) on the basis that a request for a hearing was made by twenty-five
(25) persons, a governmental subdivision or agency, or an association having
not less than twenty-five (25) members. The Court was advised by letter dated
December 5, 2005, from Susan Duncan, Legislative Coordinator for the South
Carolina Department of Labor, Licensing and Regulation, that the Board of
Examiners for the Licensure of Professional Counselors, Marriage and Family
Therapists, and Psycho-Educational Specialists did not receive any valid
requests for a hearing on the proposed regulation in the above matter, and that
the hearing will not be necessary.
IT IS THEREFORE ORDERED that the above-captioned case bearing
Docket Number 05-ALJ-11-0389-RH is hereby dismissed.
AND IT IS SO ORDERED.
