ORDERS:
ORDER OF DISMISSAL WITH PREJUDICE
This matter is before the Administrative Law Court (ALC or Court) pursuant to Petitioner's
request for relief filed on July 22, 2005. Respondent filed a Motion to Dismiss on October 14, 2005, asserting that Petitioner failed to exhaust his administrative remedies prior to filing this matter. An appeal may only be taken from a final agency decision. See S.C. Code Ann. § 1-23-380 (2005); Garris v. Governing Board of South Carolina Reinsurance Facility, 319 S.C. 388, 461 S.E.2d 819 (1995). As of the date of this Order of Dismissal, Petitioner has not responded to Respondent's Motion to Dismiss. See ALC Rule 19(A) (Any party may file a written response to the motion within ten (10) days unless the time is extended or shortened by the administrative law judge.).
IT IS THEREFORE ORDERED that this matter is DISMISSED WITH PREJUDICE.
AND IT IS SO ORDERED.
