ORDERS:
ORDER OF DISMISSAL
Hearing on the above proposed regulation is set for 10:00 a.m. on Friday, November 4, 2005. The Court was advised by letter dated October 28, 2005, from Dana R. Krajack, Counsel for the South Carolina Department of Revenue, that the Department did not receive any requests for a hearing on the proposed regulation in the above matter and that the hearing will not be necessary. Pursuant to S.C. Code Ann. §1-23-110(A)(3), a public hearing is not required because there has been no request by twenty-five (25) persons, a governmental subdivision or agency, or by an association having at least twenty-five (25) members.
IT IS THEREFORE ORDERED that the hearing scheduled for Friday, November 4, 2005, at 10:00 a.m. is canceled.
IT IS FURTHER ORDERED that the above-captioned case bearing Docket Number 05-ALJ-17-0342-RH is hereby dismissed.
AND IT IS SO ORDERED.
