ORDERS:
ORDER OF DISMISSAL
This matter is currently pending before the South Carolina Administrative Law Court. This matter involves the denial of the Petitioners’ request for an off premises beer and wine permit by the Department of Revenue based on a public protest as to suitability of the location by Mickie Ellis of Donalds, South Carolina. Based on the Agency Information Sheet sent by the Department, but for the public protest, the off-premises beer and wine permit would have been granted.
The hearing was scheduled for Thursday, October 20, 2005, and notice sent to the parties and the protestant. At the call of the case, the Protestant was not present. The court recessed for fifteen minutes and attempted to reach Mickie Ellis. The court was unable to reach Ms. Ellis and she did not appear. Because the Department would have granted the permit but for the protest and the protest has been abandoned, it is hereby:
ORDERED that this matter is dismissed with prejudice; and
IT IS FURTHER ORDERED that the Department of Revenue issue an off-premises beer and wine permit to the Petitioner for the location at 104 Main Street, Due West, South Carolina.
AND IT IS SO ORDERED.
