ORDER OF DISMISSAL

By a letter dated September 19, 2005, Dr. Charles H. Lackey, the Superintendent of Laurens County School District 56 and the sole protestant of record in the above-captioned matter, notified this Court that he has decided to withdraw his protest against the issuance of an on-premises beer and wine permit to Petitioner Palmetto Bowling Center of Clinton, Inc. Therefore, as the sole protestant in this matter has withdrawn his protest of Petitioner’s permit application,

IT IS HEREBY ORDERED that the hearing of the above-captioned case scheduled for Tuesday, October 11, 2005, is CANCELED and this case is DISMISSED.

IT IS FURTHER ORDERED that, pursuant to this dismissal, the South Carolina Department of Revenue shall CONTINUE TO PROCESS Petitioner’s application for an on-premises beer and wine permit for the premises located at 685 Peachtree Street in Clinton, South Carolina.

AND IT IS SO ORDERED.
