ORDER

On August 24, 2005, the parties to the above-referenced actions appeared before the Court via telephone as required by the August 16, 2005 Scheduling Teleconference Order filed in the matter bearing Docket No. 05-ALJ-09-0277-CC. As a result of a discussion of various issues related to these matters,

IT IS HEREBY ORDERED THAT:

1. Pursuant to Rule 19(D) of the Rules of Procedure for the South Carolina Administrative Law Court, and upon the unopposed oral motion of the South Carolina Chamber of Commerce and the Intervenors in the matter bearing Docket No. 05-ALJ-09-0294-CC, the matters bearing docket numbers 05-ALJ-09-0277-CC and 05-ALJ-09-0294-CC are hereby consolidated into the matter bearing docket number 05-ALJ-09-0277-CC;

2. The Agency Information Sheet filed by the South Carolina Department of Insurance in the matter bearing docket number 05-ALJ-09-0277-CC on July 27, 2005 shall be applicable to the matter resulting from the consolidation of actions referenced in paragraph one (1) of this Order;

3. By 5:00 pm on September 8, 2005, the South Carolina Department of Insurance (SCDOI) shall file with the Administrative Law Court and serve in like manner upon the other parties to this matter, a statement as to SCDOI’s position on the appropriate procedure under South Carolina law and regulations of changes proposed by the National Council on Compensation Insurance, Inc. in South Carolina’s voluntary workers’ compensation loss costs; and

4. No later than 5:00 pm on September 19, 2005, all other parties to this matter may file and serve in like manner their response to and comments on the SCDOI’s position statement.

AND IT IS SO ORDERED.
