This matter is before the undersigned judge based on an appeal filed by the Appellant. On January 28, 2005, an Order Governing Procedure was issued and mailed to the parties. The Record on Appeal was filed by the Respondent on February 18, 2005. The Petitioner never filed an Appellant Brief.

Upon motion of any party, or on its own motion, an administrative law judge may dismiss an appeal for failure to comply with any of the rules of procedure for appeals, including the failure to comply with any of the time limits provided by this section. ALC Rule 38.

 

It appearing that the Appellant has defaulted in this matter, this case is hereby DISMISSED.
