ORDER OF DISMISSAL

On September 1, 2005, Respondents and Petitioners participated in a conference call before this Court, wherein Respondent Dode Prickett requested that this Court issue an Order vacating Agricultural Permit No. 18,955-AG, issued by Respondent South Carolina Department of Health and Environmental Control (DHEC) for the construction of six (6) poultry breeder houses on his property in Calhoun County. Respondent Dode Prickett, with the consent of the other parties to this case, agreed that the alleged notice defects in this case are best addressed by starting the permitting process anew in the event Respondent decides to pursue constructing a poultry farm on his property in the future.

IT IS THEREFORE ORDERED that Agricultural Permit No. 18,955-AG is hereby VACATED.

IT IS FURTHER ORDERED that this matter is DISMISSED with prejudice. Pursuant to this dismissal, all pending motions in this matter are denied as moot, and the evidentiary hearing scheduled in this matter for September 15, 2005, is canceled.

AND IT IS SO ORDERED.
