ORDERS:
ORDER OF DISMISSAL
These matters are currently pending before the South Carolina Administrative Law Judge
Division. These matters involves the denial of the Petitioner’s request for an off premises beer and
wine permit and retail liquor license by the Department of Revenue based on a public protest as to
suitability of the location by Pastor Virgil Harris of Calvary Redemption Center in Spartanburg,
South Carolina. Based on the Agency Transmittals sent by the Department, but for the public
protests, the off premises beer and wine permit and retail liquor license would have been granted.
By letter received from Arthur H. McQueen, Jr., counsel for the Protestant, on March 21, 2003, the
aforementioned Protestant withdrew his protests. Because the Department would have granted the
permit and license but for the protests, and the protests have been withdrawn, it is hereby:
ORDERED that these matters are dismissed with prejudice; and
IT IS FURTHER ORDERED that the Department of Revenue issue an off premises beer
and wine permit to the Petitioner for the location at 918 Howard Street, Spartanburg, South Carolina,
and a retail liquor license for the location at 916 Howard Street, Spartanburg, South Carolina,
AND IT IS SO ORDERED.
