ORDER STRIKING CASES FROM ACTIVE DOCKET

In the above-captioned cases, Petitioner J. Rutledge Young, Jr., challenges the decision of Respondent South Carolina Department of Health and Environmental Control, Office of Ocean and Coastal Resource Management (Department), to issue permits to two adjacent property owners, Respondents Tanzy Moore and Christine Duc, for the construction of docks with boatlifts in Church Creek on Wadmalaw Island in Charleston County. By an Order dated June 7, 2005, these cases were consolidated for hearing and scheduled to be heard on August 23, 2005. At the request of the parties, this Court held a conference call regarding the possible resolution of these cases on August 4, 2005. In the conference call, the parties requested that these cases be stricken from the active docket of this Court while the parties explore alternate construction methods for the proposed docks such that the resulting docks would be acceptable to all parties. Therefore, pursuant to the request and consent of all parties,

IT IS HEREBY ORDERED that the above-captioned cases are STRICKEN from the active docket of the South Carolina Administrative Law Court and the hearing of this matter scheduled for Tuesday, August 23, 2005, is CANCELED.

IT IS FURTHER ORDERED that Respondents Moore and Duc must provide Petitioner with their proposals, if any, for alternate construction methods for the docks by Tuesday, January 3, 2006. If Petitioner is dissatisfied with these alternate proposals, he may move to have these matters restored to the active docket of this Court by filing a written motion to that effect with this Court no later than Wednesday, February 1, 2006.
