The above-captioned contested case was filed with the Administrative Law Court (Court) on January 25, 2005. On July 28, 2005, George H. O'Kelley, Jr., attorney for the Petitioner in this matter, filed a letter with the Court in which he set forth that the Petitioner was withdrawing his appeal. Therefore,
